Swiss Railways in dispute with regulator over fare dodgers and underpayers.

Federal Court to have final say on fare dodgers

The Federal Department of Transport and Swiss Federal Railways are still in conflict over the difference between fare dodgers and passengers who pay for a second class ticket but travel in first class.

It goes back to last March when the transport department supported the case of a traveller who said it was unjust for people who^ve not paid the correct fare to pay the same 80 franc fine as people who dodge fares altogether.

But Swiss Federal Railways say it must have uniform fines because of the administrative costs involved.

The case will now go to the Federal Court in Lausanne.

The law is probably different over there, in the UK^▸ we have very clear laws on "fare evasion" covered by the Regulation of Railways act 1889.

Agreed. The law is different in the UK. here I think that it is clear that if you are travelling in First on a SC ticket you are treated as not having a valid ticket same as travelling with no ticket at all. So long as the position is clear (and I think it is) I don't see a problem with the situation under Uk law.
