Title: Malicious Damage Act 1861 - why use such an old law? Post by: grahame on April 11, 2023, 22:52:56 From Yahoo! News (https://uk.news.yahoo.com/convicted-under-162-old-law-155538828.html)
Quote A North Yorkshire man who caused problems at a railway station today has a criminal record after he was prosecuted under a 162-year-old law. Lewis Connors, 25, also has a £585 court bill. York Magistrates Court heard he refused to leave a train when told to do so at Peterborough Railway Station. His actions disrupted the operation of the railway, the court was told. Connors, of Steeton near Tadcaster, was prosecuted under the Malicious Damage Act 1861. How many of the members here even know of this law ... or what it says? Quote ROYAL WOOTTON BASSETT: Ned Lee, of Marlborough Road, must pay £500 in compensation and £85 in court costs after blocking a railway carriage by refusing to leave a train when required to do so by staff at Peterborough Railway Station on November 25, 2021. You can read about the remaining parts of the act at https://www.legislation.gov.uk/ukpga/Vict/24-25/97/contents (https://www.legislation.gov.uk/ukpga/Vict/24-25/97/contents) Without more detail, my money is on section 36 Quote Obstructing engines or carriages on railways. Whosoever, by any unlawful act, or by any wilful omission or neglect, shall obstruct or cause to be obstructed any engine or carriage using any railway, or shall aid or assist therein, shall be guilty of a misdemeanor, and being convicted thereof shall be liable, at the discretion of the court, to be imprisoned for any term not exceeding two years," Section 35 is also interesting as it carries the penalty of life imprisonment for tampering with the railway.
