Train and lorry collide on Carmarthenshire level crossing 

A passenger train from Pembrokeshire has collided with a lorry carrying hay at a level crossing in Carmarthenshire.

Emergency services say three people on the Milford Haven to Manchester service suffered minor injuries in the crash near Whitland at 09:50 GMT.

Oxygen was given to one and another was treated for a head wound before they were taken to hospital.

Arriva Trains Wales (ATW) said replacement buses would run between Carmarthen and Milford Haven.

All train services on the south Wales line west of Carmarthen have been stopped.

ATW said the train involved was the 0910 Milford Haven to Manchester service, with between 50 and 60 passengers on board.

It was not derailed in the incident and BBC Wales reporter Aled Scourfield, close to the scene, said the lorry was still upright.

The incident happened at the Llanboidy level crossing on a minor road near a spot called Crossing Cottage.

British Transport Police (BTP), Dyfed-Powys Police and paramedics were at the scene between Whitland and Henllan Amgoed.

The Welsh Ambulance Service said two ambulances and the Wales Air Ambulance were sent to the scene.

Crews treated three people at scene for minor injuries before taking them to West Wales general hospital in Carmarthen for further treatment.

Mid and West Wales Fire and Rescue said it appeared the crossing barrier came down on the lorry before the train collided with it.

A BTP spokesman said: "An investigation is underway into the cause of the collision, including how the vehicle came to be on the tracks, and the Rail Accident Investigation Branch (RAIB) has been notified."

Engineers and rail managers have gone to assess the damage and help passengers.

Looks like a frightening incident from the pictures. Very fortunate that injuries were not worse, and looks like 175002 will be out of commission for some considerable time to come.

Interesting to note that (assuming the reports are correct) this happened at a half-barrier level crossing; my immediate assumption was that it would have been an unprotected occupation farm crossing.

Looks like a 'write off' to me. The front part of the carriage is badly damaged. Good to hear that there weren't any serious injuries with the train bearing the brunt of the impact.

A write off? Given there's no slack at all in the ATW 175 fleet, that's very bad news if true.

BBC Wales today suggested the lorry was stuck on the level crossing with nobody in it when the train hit, is this correct as earlier posts on this topic suggest the lorry went through the lowered barrier.

Exactly what time did this happen, is the unit from the 09:56 from Fishguard stuck west of the level crossing? If so, how long until they can move the broken 175 and get the sprinter out?

The main thing is that no-one was badly injured in this accident, however it will mean ATW 175s will be even more stretched.

The one that forms the 09xx from Milford to Manchester ends up going back from Manchester at 15.30 to Pembroke Dock - tonight it was a 150 and 158 making a 4 car (at least from Cardiff onwards it was) so im guessing a 150 and/or 158 will cover the diagram the 175002 would be on.

From what I can tell from the pictures, although the front cab is badly smashed up the structure of the rest of the vehicle looks relatively intact - I don't know how the 175s are constructed but if it's possible to graft on a new cab then might be a bit soon to dismiss the unit as a write-off. That said though, even if it isn't written off it's likely to be in the shop for a long time being repaired.

As ever, probably best to remind everyone to refrain from speculation about precise causes until more facts have been established.

Passenger Skip Maloney told BBC Wales of the moments leading up to the crash. "The [train] driver slowed down just before we hit," he said.

He said he carried out first aid on a woman sat behind him but no-one suffered serious injuries. "I think everyone was suffering from shock a bit," he added.

Juan Giner who was travelling home to Spain said: "Everything was fine and suddenly the train stopped in a very strong way - very dramatically. The train continued for 100 yards moving the lorry along. It's incredible that the driver of the train survived because the whole of his room was completely crushed. I'm really thinking this could be an incredible tragedy."

Network Rail said all passengers had been led to safety. A spokesperson said: "Engineers are currently assessing the damage to the rail infrastructure and train respectively. Emergency repairs will be carried out once investigation is completed."

Work has started to prepare for emergency repairs and a crane has been commissioned to lift the lorry away from the track.

Network Rail engineers are expected to work through the night to restore services to normal as quickly as possible.

Train services between Carmarthen and Milford Haven have been cancelled and an amended service will be provided for by Arriva Trains Wales from Wednesday morning.

Passengers are advised to check with National Rail Enquiries or Arriva Trains Wales before starting their journey.

A spokesperson for the Office of Rail Regulation (ORR) said it had an inspector on site.

"ORR will work with the BTP and other agencies to find out exactly what happened and quickly identify the causes of this incident," they added.

Looking at some side on pictures on the daily mail website, the damage to the main body of the carriage doesn't look as bad as it does from the overhead picture on the bbc website so maybe it can be saved. Just the cab that is very badly damaged. Amazing the driver wasn't seriously injured.

From the pictures it looks as if it is just the cab of 175002 which would need to be replaced however we dont know about the damage to the undercarriage.

The fact that the trains remained on the rails and the only damage that can be seen is to the cab just goes to show how well built the class 175's are.

Looks like we can expect more 150's to run up on the Cardiff - Holyhead services with ATW now having to really stretch the 175 fleet until 175002 is back in action.

I am glad that this accident was not as bad as it could have been and I wish everyone a speedy recovery especially the driver.

well done to the driver for managing to loose some speed before impact and to the folks who designed the vehical to widestand this sort of thing.  Very pleased that their combined efforts meant no serious injuries.

The investigation will identify the exact sequence of events that led to the accident.  It will also include consideration of the layout of the level crossing, the actions of the lorry driver, the factors which caused the lorry to stop on the crossing and the crashworthiness of the Class 175 unit involved in the collision.

The RAIB's investigation is independent of any investigation by the police or safety authority (the Office of Rail Regulation).

The RAIB will report on its findings, including any recommendations to improve safety, at the conclusion of its investigation.  This information will be available on the RAIB website.

Very interesting S&T that you should mention the Hixon accident. This was one off the case studies in a third year OU course Systems Course I took in the early 80s.

The main thing about Hixon was that the haulage company had had similar incident previously  of one of their low loaders getting  stuck on crossing on  the Newport Shrewsbury line. However, they got it before a train came. However no lessons were learnt.

Non fatal precursors seemed to have precceded many of the accidents studied on the course and subsequently when other accidents have occurred if you dig dep in the reports you will often find that there non fatal precursors, which didn't trigger alarms.

The most obvious being the 6th SPAD (ye gods Mr Wadmore at Waterloo in the early 60s would have had the S&T Engineer and the Motive Power Superintendant on his carpet demading something was done and ASLEF would have blacked the signal) of SN109 ( 4/2/1998) when an HST overan by 432 yards Fournately teh signaman wa able to put SN120 on the up Main to Red and teh up Heathrow amde an emergency stop. For inforamation the accident was the 9th SPAD.

Cullen says in his report that this SPAD was marked disregard! Whereas it should have alerted HMRI and Railtrack and the TOCs to the incorect position of points 8059B (facing for Down trains) set Line 3 to UP main rather than Down Relief.

Unfortunately Cullen fudges the provision of flank protection in his report.

- Alstom and Angel Trains to review the coupler bump stop mounting and retention arrangements.

Barristers acting for Davies said a railway accident report mentioned that his view was obstructed by Network Rail vehicles parked alongside the crossing, and the lights on the railway crossing were not properly aligned.

The court heard that when the barriers came down Davies thought it was Network Rail staff messing about.

He got out of his cab to remonstrate and seconds later the train hit the lorry, the court was told.

Now he has pleaded guilty I feel it is safe to highlight that the RAIB report noted he had been stopped by the police in connection with driving an oversize vehicle combination prior to the incident.  The vehicle had also been stopped on more than one occasion with other drivers in charge before.  (Paragraphs 21 and 22)

If we had plea bargains in England and Wales, they may have looked like this, with him pleading to an offence that covers wilful action, wilful inaction, or negligent action, but on the basis of negligence. I am assuming - it doesn't tell me in any of the reports - that he was charged under section 34, Offences Against the Person Act 1861"Whosoever, by any unlawful act, or by any wilful omission or neglect, shall endanger.." the safety of passengers.

Maximum sentence is 2 years. Discount will be given for the guilty plea, even though the presence of the signs removes any chance of getting away with it. The rest depends on what notice the judge takes of the barrister's comments about the misaligned lights and parked vehicles, compared to the aggravating factor of the driver not following the correct protocol. Judges like a discount, or an excuse for a suspended sentence, but although no-one died, four people were badly hurt, 26 slightly hurt, one shocked, and 56 inconvenienced. We shall see, but if I were him, I would cancel the milk and remember to take a toothbrush on sentencing day, just in case.

The Offences Against the Person Act 1861 predates motor vehicles, so doesn't contain provision for endorsement or disqualification. I doubt he will keep his no claims discount.

Following a British Transport Police (BTP) investigation, Davies, aged 49, of Castell Pigyn, Llanboidy, Whitland, was today (Friday) sentenced at Swansea Crown Court after pleading guilty at an earlier hearing to endangering the safety of persons using the railway.

Sentencing, Judge Keith Thomas said: ^This was a very serious incident and there was clearly a high degree of neglect on Mr Davies^ part. This incident resulted in a huge cost to the train operating company ^ more than ^819,000 - , but the potential consequences of the collision Mr Davies caused are far more serious than the financial cost. It must have been a hugely frightening experience for everyone concerned, especially the train driver who acted swiftly and conscientiously. The consequences could have been very dire indeed. The offence is so serious that clearly a custodial sentence is justified, but it is a sentence I am willing to suspend.^

The court was told that at 9.40am on Monday, 19 December 2011, Davies was driving his Scania flat bed lorry and trailer, and was on his way to make a delivery. He had a full load of hay, weighing upwards of 30 tonnes, when he drove up to the level crossing.

Road signs on the approach to the crossing clearly stated that drivers of large or slow vehicles must phone the signalman and get permission to cross. Davies ^ who later admitted he did not know the length of his vehicle - did not stop or use the crossing telephone.

His vehicle was struck by the 0910hrs Milford Haven to Manchester Piccadilly Arriva Trains Wales service.

The train came to rest 50 yards down the track, with the lorry wedged under its front.

Of the 49 passengers on board the service, which was travelling at 68mph, four were taken to hospital suffering minor injuries, one of which suffered cracked ribs. There have been numerous personal injury claims to Arriva Trains Wales and some of the passengers are receiving ongoing treatment.

The line was closed for two days following the incident to allow for the recovery of both vehicles. The train suffered a huge amount of damage and was out of service for 209 days, while the lorry was damaged beyond repair.

Total costs incurred by Arriva Train Wales as a result of the incident were ^819,821 ^ this includes recovery of the train, repair costs and the running of replacement services.

Davies was sentenced to 37 weeks imprisonment, suspended for 18 months, and was ordered to carry out 300 hours of unpaid work on behalf of the community. He was also told to pay ^1,200 prosecution costs.

Chief Inspector Sandra England, British Transport Police Welsh Sector Commander, said: ^It is astounding that no one was seriously injured or killed in this incident. Davies^ actions not only put rail staff and passengers^ lives at risk but also caused massive disruption to the rail infrastructure. Although Davies made a full and frank admission, this was an extremely foolish act, the severity of which is reflected in the custodial sentence he has received.^

Mike Tapscott, Operations and Safety Director, Arriva Trains Wales, said: "The severity and impact of level crossing misuse to the safe running of the railway cannot be underestimated."

A hay truck driver who caused a train crash injuring passengers has been given a suspended jail sentence.

Oswald Davies, 49, was told he had shown a "high degree of neglect" after admitting endangering passengers' lives at Whitland, Carmarthenshire.

The driver of the Milford Haven to Manchester train could not stop in time after spotting the lorry across the line, Swansea Crown Court heard.

Davies' nine-month sentence was suspended for 18 months.

The court heard 24 passengers suffered minor injuries in the accident which caused ^250,000 in damages to the train and the cost of diverting services. Bales of hay were scattered across the track after the train hit the lorry on the Henllan Amgoed railway crossing.

Davies, of Llanboidy, Carmarthen, was also ordered to carry out 300 hours of community work.

Judge Keith Thomas told him: "There was a high degree of neglect on your part. You were driving a truck and trailer carrying hay towards a sign telling drivers they must stop and phone to obtain permission to cross the line. You did not obey the sign."

The court heard that Davies had driven over the same crossing hundreds of times in the past few years. He told Swansea Crown Court: "I was terrified when it happened but thankfully no-one was killed." But he claimed he did not think that the signs warning long-load drivers applied to him.

Judge Thomas said: "This deserves a custodial sentence but because of Davies's good character I am able to suspend the sentence."

After the hearing, Chf Insp Sandra England, the British Transport Police Welsh sector commander, said it was "astounding that no one was seriously injured or killed in this incident".

"Davies's actions not only put rail staff and passengers' lives at risk but also caused massive disruption to the rail infrastructure."
